Terms & Conditions

1- Service Scope

• TBIKE Company is the legal and lawful owner of the motorcycles displayed through the app and rents them to others according to the terms of this contract.
• The customer's role is limited to renting and using the motorcycle within the period specified in the contract, and they may not sublease or transfer the motorcycle to others in any form.
• The company has the right to retrieve the motorcycle immediately without prior notice if it is proven that the customer misused it or violated the terms.

2- Customer Obligations

• Drive the motorcycle according to traffic regulations in force in the Kingdom of Saudi Arabia, with the obligation to wear a helmet and all safety equipment.
• Return the motorcycle at the specified time and in the same condition as received, with the same fuel level or pay the refueling difference.
• Pay all traffic fines or costs of damages resulting from misuse or accidents, including compensating the company for the motorcycle's downtime due to repairs.
• Not use the motorcycle for: racing or dangerous experiments, commercial transportation or paid passenger transport, any activities contrary to law or public order.
• Immediately report to the company and competent official authorities in case of accident, theft, or loss of the motorcycle, while bearing full legal and financial responsibility.
• Bear full responsibility for any physical injuries or material damages to themselves or others while driving the motorcycle.

3- Company Liability Limits

• The company is committed to conducting maintenance and ensuring the motorcycle's readiness before delivering it to the customer.
• The company bears no responsibility for: traffic accidents or physical injuries or death resulting from the customer's or others' driving, damages arising from customer negligence or violation of laws or usage instructions, loss or damage to customer's or third party's property as a result of motorcycle use.
• The customer acknowledges that the company is not responsible for any direct, indirect, or consequential damages, including loss of profits or business disruption.
• In case the motorcycle is subject to total damage or theft, the customer is obligated to pay its market value or the compensation amount determined by the company.

4- Compensation

The customer is obligated to compensate the company for all claims, losses, damages, or expenses (including attorney fees) that it may be exposed to as a result of the customer's violation of the terms of this contract, negligence, or misuse of the motorcycle.

5- Contract Termination

• The company has the right to terminate the contract and retrieve the motorcycle immediately without prior notice if: the customer violates any of the terms, delays in paying financial dues, misuse of the motorcycle is proven.
• The company has no obligation to compensate the customer for the remaining period in case of contract termination due to their breach of terms.

Booking and Payment

• All bookings made through the app are considered binding and final upon completion of electronic payment, and the user has no right to demand cancellation or refund except according to the cancellation policy determined by the company.
• The renter may not assign the booking to others or sublease the motorcycle.
• In case of payment method rejection or banking operation failure, the booking is considered void without any liability on the company.
• The company has the right to modify rental prices and additional fees (such as delivery, fuel, or maintenance fees) at any time, provided they are clearly displayed in the app before completing the booking.
• All fees include applicable taxes and government fees, unless otherwise stated.

Motorcycle Usage

• The renter is committed to using the motorcycle for personal purposes only, according to traffic laws and regulations in the Kingdom of Saudi Arabia.
• The renter is prohibited from driving the motorcycle: by a person not registered in the contract or who does not hold a valid driving license, in races, demonstrations, sports activities, or any illegal use, for commercial transportation or order delivery or any profit purpose not previously approved by the company.
• Driving the motorcycle under the influence of alcohol, drugs, or any substances affecting mental capabilities is prohibited.
• The renter bears full responsibility for any traffic violations or fines issued during the usage period.
• The renter is committed to maintaining the motorcycle and its accessories (keys, helmet, insurance, license plates), and in case of loss of any of them, bears the replacement costs.

Damages and Liabilities

• In case of accident or motorcycle damage, the renter is immediately obligated to notify the company and competent official authorities, with providing an official accident report.
• The renter bears all financial obligations resulting from the accident (compensations, fines, repair expenses, towing or transportation costs), unless it is proven that the cause is a technical defect in the motorcycle not apparent to the renter.
• In case of returning the motorcycle damaged or in a condition unfit for use, repair costs are estimated by the company's approved maintenance team, and this report is binding for the renter.
• The renter is obligated to pay the compensation value within a period not exceeding (7) working days from the claim date.
• In case of theft or total loss, the renter bears the full value of the motorcycle according to market assessment or the compensation value determined by the company.

Insurance (if applicable)

• If the motorcycle is insured, the insurance coverage is subject to the company's insurance terms and policy.
• The renter may be asked to pay a deductible amount when an accident occurs, even if the motorcycle is insured.
• Insurance does not cover the following cases: driving under the influence of drugs or alcohol, serious traffic regulation violations (such as running red lights, driving against traffic), using the motorcycle in unauthorized activities (racing, commercial delivery, etc.).
• The renter remains responsible for any amounts or damages not covered by insurance.

Account and In-App Usage

• The user is committed to providing accurate data when registering (name, ID, driving license, payment method).
• The company is not responsible for any unauthorized use of the renter's account due to their negligence in keeping login data and password secure.
• The company has the right to suspend or cancel any account in case of proven misuse of the app or providing misleading data.

Company Liability Limits

• The company's responsibility is limited to providing a motorcycle suitable for use at the start of booking.
• The company does not bear any obligations for indirect damages, such as loss of profits or moral damages or business disruption.
• The company is not responsible for damages resulting from bad weather conditions, natural disasters, or any force majeure beyond its control.
